【Abstract】This paper centers on the current situation of human rights in China, the characteristics and advantages of China’s human rights, the defects and problems of the protection of human rights.It also put forward some methods to solve problems and improve the situation of human rights in China.【Key Words】Human Rights;Advantages;Protection;Defect;Improvements
1.Introduction
The iue of human rights has become one of the most significance and common concern in the world community.The series of declarations and conventions which were adopted by the United Nations have won the support and respect of many countries.The Chinese government has also highly appraised the Universal Declaration of Human Rights.However, the revolution of the situation in regard to human rights is circumscribed by the historical, social, economic and cultural conditions of many nations, and involves a progre of historical development.Owing to tremendous differences historical background, social system, cultural tradition and economic development, countries differ from their understanding and practice of human rights.The Chinese people have derived their own viewpoints on the human rights iue and formulated relevant laws and politics.It is stipulated in the Constitution of the People’s Republic of China that all power in the republic belongs to people.After 30 years of development, China is on a path of human rights' development with Chinese characteristics.2.The characteristics and advantages of China’s human rights 2.1 Chinese human rights have three salient characteristics.2.1.1Extensivene It is not a minority of the people or a part of cla or social stratum but the entire Chinese citizens who constitutes the subjects enjoying human rights.The [键入文字] human rights enjoyed by the Chinese citizenry encompa an extensive scope, including not only survival, personal and political rights, but also economic, cultural and social rights.The state pays full attention to safeguarding both individual and collective rights.In 14-25, June 1993, the Second World Conference on Human Right was held in Vienna.The Conference adopted the Vienna Declaration and Programmer of Action.One of the significant achievements of this documents is the emphasis on human rights are universal and extensive.2.1.2Equality China has adopted the socialist system after abolishing the system of exploitation and eliminating the exploiting cla.The Chinese citizenry enjoys all civic rights equally irrespective of the money and property status as well as of nationality, race, sex, occupation, family background, religion, and level of education and duration of residence.2.1.3Authenticity The state provides guarantees in terms of system, laws and material means for the realization of human rights.The various civic rights prescribed in the Constitution and other state laws are in accord with what people enjoy in real life.China’s human rights legislation and politicized are endorsed and supported by the people of all nationalities and social strata and by all the political parties, social organizations and all walk of life.2.2 The advantages are significant

China’s socialist democratic centralism can concentrate o the construction of human rights protection system.Once a resolution is adopted, we can quickly implement.The establishment of the socialist system, people throughout the country continue to improve the human rights situation on the basis of equitable sharing of economic development and the fruits if labor, the protection of the basic social system.2.2.2
China has a large population, the focus of human rights protection system on the basis of political rights and to concentrate on the effects to establish to meet the majority of the people is to meet the majority of the peasants’ right to survival, development rights ,cultural rights and other social rights, human rights.This practice effectively solves the problem of more than 10 million people’s right to subsistence and development.3.The problems of human rights protection in china [键入文字] “Human rights development is a gradual proce.China is a developing country with a population of 1.3 million and chin’s human rights protection still faces many problems and difficulties.”(Wang Chen, Information Office of the State Council director)3.1 The rights citizenry deserve are not safeguarded
China’s human rights protection system has a lot of loopholes.Many rights that citizenry deserve are not safeguarded though they are written on the laws and poultices.Freedom of speech, voting rights, private property rights, freedom of belief, freedom of aociation and protest power and some other power are all not implemented in practice.3.2 Chinese people have no awarene of the protection of their human rights
Awarene of human rights is the premise of the protection of human rights.Without the awarene of human rights, those so called respect, protection of human rights are all false.But now due to the lack of government propaganda and the different level of civic, the understanding of the importance of human rights is very low.3.3 China’s human rights protection system can’t catch up with the international standards
According to Human Rights Report published in 2011, the current released politics in China are not consummate.“We live in an equal society, so we should have equal rights.”(Human Rights, 2009, 02)
4.The ways to improve
4.1 Improve citizenry’s awarene of human rights protection
It’s very important to improve the awarene of Chinese people because as long as we realize we should protect ourselves, we can be protected by the laws.One of the effective ways is to make human rights protection as a major iue in schools.“We just don’t talk about human rights in general in this country.I blame it in part on culture.It’s a clear failure.” Said Profeor Li Yang(a profeor from Peking University who push for a human rights degree program)It’s very useful because the educated in China occupy a large proportion in Chinese population.4.2 Adhere to the Chinese model of human rights protection system As we all know, since World War II the United States and Britain is the word of mainstream society.The U.S.human rights is the most critical power of the human society.And this is the root cause of the United States that can dominate the world.China should learn from the United States to establish an equal society.However, unlike other countries, [键入文字] China’s political system is unique.China’s protection of human rights can not be imitated in other countries, we can only develop in our Chinese model.“China has confidence to go its own road of development of human rights.”(Beijing Daily, 6, 16, 2012)
5.Conclusion There is now a change over the world pattern from the old to the new, and the world is more turbulent than before.Human rights protection will be more and more important in the construction of society.I believe that with the progreive development of China’s human rights protection system will be more and more perfect.References Human Rights Report, 2011 Human Rights
