福利权利是社会成员从社会获得基本生活保障的权利。从某种意义上，可以
将福利权利理解为社会成员有权享有特别的物品和服务。在公民的权利体系中，社会福利权是其中一个重要组成部分，是一项最基本的权利。与公民的其他权利
相比，社会福利权属于一种新型权利。从《世界人权宣言》和《经济、社会和文
化权利公约》看来，社会福利权利是一种人权，也是一种经济、社会和文化权利。
本文以唯物史观为指导，运用学科交叉的研究方法，大量借鉴了国内外历史
学、社会学、政治学、法学的研究方法和研究成果，具体、深刻地阐述了美国福
利权利的演变、立法及其救济。论文共分为三部分： 第一部分论述了美国福利权利的演变。从建国后到19世纪末，美国的社会
福利基本上是社会救济，因此还谈不上福利权利，只涉及到社会救济权。这样的情况与当时人们的思想观念密切相关。进步运动时期，社会福利方面取得了很大
进步。各州通过了关于老年保障、失业保障以及工伤保障的社会立法，这在一定
程度上保障了人们的福利权利。1929，1933年的经济危机改变了社会各界和政府
对福利的看法，具有福利权利思想的罗斯福上台推动了社会福利立法。“社会保
障法”的诞生，标志着联邦政府承担起了为所有公民提供经济保障的责任。人们的社会福利权利得得到了法律保护。
第二部分概述了美国福利权利方面的立法及其特点。白福利权利确立以来，美国各界政府又通过了很多福利法令，从而使福利权利不断丰富和发展。战后最
初25年的改革调整，大大扩大了社会福利的范围和对象。如1946年的《就业法》、1949年的《美国住宅法》、1958年的《国防教育法》、1964年的《经济机会法》、1965年的《医疗照顾法》、《中小学教育法》和《高等教育法》等，这一系列有关
就业、失业、教育、医疗、住房等保障措施，已使美国的社会福利形成特色，并
成为名副其实的“福利国家”。60年代“伟大社会”纲领推行的结果是福利计划的扩大。70年代的“滞胀”使社会福利政策的财源大成问题，这又势必加重纳税
人的税收负担。因此，在70年出现了抗税的呼声，社会福利政策受到抨击。到
里根时，由联邦支持的社会福利保障事业进入了紧缩时期。
第三部分探讨了美国福利权利的救济。本部分首先通过与《世界人权宣言》的对比，指出美国联邦宪法缺乏关于福利权利的规定，各州宪法在福利权利规定

方面明显不足。因此当福利权利受到侵害时，联邦最高法院的审理态度摇摆不定。
在洛克纳时代联邦最高法院在福利问题持否定态度。罗斯福新政时期，最高法院
在对一系列社会保障法案判决中予以支持。特别是在西岸宾馆诉帕里什案中，法
院认为州宪可以规定最低工资。此后法院承认了国家确有义务援助贫穷者、年老
者或失业者。社会福利也被看作自由内容的扩张，是普遍的公民权利，而不再被
认为是一种慈善事业或者特权。到了20世纪60年代，沃伦法院时代和伯格法院
时代的早期，开始以正当程序、“新平等保护”条款为依据来支持福利案件中的请
求。进入20世纪80年代以后，最高法院在一系列的判例中对福利权利问题持节
制态度。
